HOW TO GET ITALIAN CITIZENSHIP?

So, before starting thinking to get an Italian Passport and be an owner of Italian Dual Citizenship, you have to clear IF you may be entitled to apply for Italian Citizenship and – if the answer is “Yes” – on which Italian Citizenship path, from the ones listed below. 

According to the ius sanguinis or jure sanguinis (by birth, recognition or adoption, by even one parent Italian citizen – so-called Italian Citizenship Jure sanguinis), or according to ius soli (only born in Italy by stateless parents or by known parents whose legal system of origin does not contemplate the ” ius sanguinis “).

These special cases are always considered in the category of “Italian Citizenship by Descent“, but you apply for them when You have a woman in the bloodline and she had her next in line before January 1, 1948.

ITALIAN CITIZENSHIP BY RESIDENCE

After 10 years of legal residence in Italy. 

The term is reduced to 3 years for former Italian citizens and their immediate descendants (ius sanguinis) and for foreigners born in Italy (ius soli), 4 years for citizens of other countries of the European Union, and 5 years for stateless persons and refugees.

After 3 years of marriage with an Italian Spouse (if You live outside EU), you are entitled to apply for Italian Citizenship by Marriage.

The time is reduced to 1,5 years if you have children.

#1. ITALIAN CITIZENSHIP BY DESCENT

As we already deeply talk about it on the Italian Citizenship by Descent dedicate page, We now enlist the main aspects and the Italian Citizenship requirements for applying for an Italian Passport through Your Italian grandparents (or Italian great-grandparents, and so on back for generations).

When we talk about Italian Citizenship by descent or Italian Citizenship Jure Sanguinis, we refer to the same situation. 

In this case, you will have to claim Italian Citizenship because of the fact You had Italian Grandparents or Italian Great-Grandparents, and so on – and they never naturalized as foreign Citizenship (so they never lost their Italian Citizenship). 

Or, if they naturalized, they did it after the birth of the next in line (their son or daughter).

Italian Citizenship by Marriage is a particular option to get an Italian Passport simply for the fact You are married to an Italian spouse. 

So, you may think it’s pretty easy to get Italian Citizenship in this way, just because you have a Marriage Certificate – unfortunately, it’s not. 

Why the path of Italian Citizenship by Marriage may be difficult? 

The main reason is that this program (like the Italian citizenship through residency program) was amended several times in the last decades, with the last big modification in 2018, with Law  No. 132/2018 that introduced the Italian Language requirement and new [longer] processing time (maximum 48 months)

In order to be sure to submit a correct Italian Citizenship by Marriage application, there are several documents to prepare and some important tips to remember. 

This is one of the first document to obtain, as it takes time. The certification may be demonstrated in ONE of the following ways:

  • A DEGREE issued by a public instructional institution or equivalent in Italy or abroad, recognized by the Ministero dell’Istruzione dell’Università e della Ricerca, and by the Ministero degli Affari Esteri e della Cooperazione Internazionale, OR,
  • A CERTIFICATE OF KNOWLEDGE OF ITALIAN LANGUAGE AT LEVEL B1 (or higher), issued by one of the following institutions:
    • Universita’ per stranieri di Siena
    • Universita’ per stranieri di Perugia
    • Universita’ Roma Tre
    • Società Dante Alighieri

The way to apply for Italian Citizenship by Marriage is a little different, in case you are applying abroad (as a resident outside Italy) or in Italy (as an Italian resident).

The procedure may be divided into 2 phases, in both cases. 

First of all, You have to submit electronically Your Italian Citizenship application, with all paperwork scanned and submitted to the Italian Citizenship Department at the Italian Ministry of Internal Affairs.

The procedure was recently amended on this part, as the Italian Government requires to have a digital identity SPID, in order to be clearly identified as an Italian Citizenship Applicant. 

That’s not an easy process, and that’s why of the many reasons You need an Italian Citizenship Lawyer to assist You during the process.

After this 1st phase, and after a brief evaluation of Your Italian Citizenship by Marriage application documents, You will have to bring the original ones at the local Italian Authority in charge for all Italian Citizenship applications

#3. ITALIAN CITIZENSHIP BY RESIDENCY

This type of Italian Citizenship Program is the oldest one and the most common – the naturalization as an Italian Citizen after living here for several years. 

Following the general rule set by the Italian Citizenship Law 91/1992, you will naturalize as Italian Citizen after 10 years of legal and uninterrupted residency in Italy. 

The term is reduced in some specific circumstances:

  • to 3 years for former Italian citizens and their immediate descendants (ius sanguinis) and for foreigners born in Italy (ius soli),
  • 4 years for citizens of other countries of the European Union,
  • and 5 years for stateless persons and refugees.
As this Italian Citizenship is related to the fact of living in Italy, there are different requirements than the other 2 Italian Citizenship programs listed above.

Basically, except for the Italian Language Test [that’s a common requirement with Italian citizenship By Marriage], you will need to demonstrate your uninterrupted residency in Italy, to have paid Italian Taxes and to have a minimum annual income not below of 9,000€.

What Documents do we Need from You?

What we need from You, for Assisting You on Italian Passport application

Pay Attention: The List Below is not complete as it refers to general Citizenship programs. So, This must  not be considered a Legal Advise.

Complete List and correct Italian Citizenship Application will be processed by Us for Clients-only.

The documents for the most frequent requests (residence and marriage) are indicated below.
For other cases, information will be provided by the Law Firm only after the power of attorney has been conferred.

 

1. Application form.
We prepare and forward it to the competent office.

2. Birth certificate (translated)
The extract of the birth certificate must contain all the details of the applicant.
This document must be translated and legalized by the Italian diplomatic or consular authority present in the state of origin of the citizen.

WARNING: for foreign citizens who have acquired the surname of the husband it is important to verify that the birth certificate contains both the maiden name and the married one.

3. Criminal certificate
This is the criminal certificate of the country of origin. This certificate is not necessary if the citizen was born in Italy or if he / she resides in our country from before the age of 14 (the certificate must be legalized and translated as occurred for the birth certificate).

In addition to the criminal certificate of the country of origin, a certificate of the judicial register and of the pending charges in Italy is required.

ATTENTION: if the applicant has also resided in other countries it is necessary to present the criminal certificate for each of these countries.

4. Photocopy of the passport
A phoocopy of the valid passport is required.

5. Photocopy of the residence permit
A photocopy of a valid residence permit is required.

* citizens coming from the EU will have to request and present the permanent residence certificate (issued by the municipality of residence).

6. Residence
Full documentation of residence certificates with the history (the discontinuity of residence is one of the reasons why applications are often rejected).

7. Model CU, Unico and model 730
Depending on the employment position of the applicants, Model CU, Unico and Model 730 will be presented on the income received in the last 3 years.

Maid, carers and domestic workers will have to present the INPS statement.

In the event of the impossibility or inadequacy of the income of the last three years, it is sufficient that the current income is adequate.

8. Copy of the contribution of € 250.00
We need to make a payment of € 250.00 on the current account number 809020 payable to: Ministero Interno D.L.C.I. citizenship – with the causal: citizenship – contribution as per art. 1 co. 12, law 15 July 2009 n. 94. A copy of the payment receipt must be attached to the documentation.

9. Family Status Certificate.
Only if you live with your family and/or other certificate people like that.

10. (Only for Citizenship for marriage/civil Union) Authenticance Certificate of Marriage / Civil Union.

If it’s a Certification from foreign State, it must be registered in Italy before using it.
